Agritourism Assumption of Risk, Release of Liability & Participation Agreement

Please read this agreement carefully before purchasing tickets. By checking the acceptance box during checkout, you acknowledge that you have read, understood, and agree to the following terms on behalf of yourself and any minors for whom you are purchasing tickets.

1. Voluntary Participation

I understand that participation in activities at BlueRock Farm Market, BlueRock Pumpkin Patch, and all associated agritourism attractions is entirely voluntary. I choose to participate knowing that farm and outdoor recreational activities involve inherent risks that cannot be completely eliminated.

2. Acknowledgement of Inherent Risks

I understand that agritourism activities take place on a working farm and may involve known and unforeseen hazards, including but not limited to:

Uneven ground, dirt roads, gravel, mud, rocks, holes, roots, irrigation equipment, and changing terrain.
Exposure to weather including heat, cold, rain, wind, dust, smoke, lightning, or poor air quality.
Slippery or wet surfaces.
Farm equipment, tractors, trailers, wagons, utility vehicles, fences, gates, tools, and machinery.
Contact with livestock and farm animals, including bites, scratches, kicks, head butts, stepping, unpredictable behavior, and allergic reactions.
Corn stalks, straw bales, pumpkins, plants, insects, bees, spiders, snakes, rodents, wildlife, and other natural hazards.
Physical activities including climbing, jumping, sliding, running, riding, walking, and navigating attractions.
Risks associated with hay rides, wagon rides, train rides, climbing walls, bungee trampolines, corn mazes, slides, petting zoos, pumpkin patches, paintball attractions, and children's play areas.
Crowds, noise, and interactions with other guests.
Falls, slips, trips, collisions, or equipment failure despite reasonable maintenance.
The possibility of serious bodily injury, permanent disability, illness, property damage, or death.

I acknowledge that these risks are inherent to farm recreation and cannot be entirely eliminated.

3. Physical Condition

I certify that I and those included in my ticket purchase are physically able to participate in the activities selected.

I understand certain attractions may not be appropriate for individuals with medical conditions, pregnancy, mobility limitations, heart conditions, recent injuries, or other health concerns.

I accept responsibility for determining whether participation is appropriate.

4. Supervision of Children

Parents and legal guardians are solely responsible for supervising their children at all times.

BlueRock Farm Market does not provide childcare or individual supervision.

Children must follow all posted rules and employee instructions.

5. Rules and Safety Instructions

I agree to:

Follow all posted signs.
Follow instructions given by BlueRock staff.
Use attractions only as intended.
Respect animals and other guests.
Stay within designated guest areas.
Refrain from unsafe, reckless, or disruptive behavior.

BlueRock reserves the right to remove any guest who violates safety rules without refund.

6. Assumption of Risk

To the fullest extent permitted by law, I voluntarily assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, including risks arising from the inherent nature of agritourism activities.

7. Release of Liability

To the fullest extent permitted by Idaho law, I release, waive, discharge, and hold harmless BlueRock Farm Market, its owners, officers, members, managers, employees, volunteers, contractors, sponsors, landowners, and affiliates from any claims, demands, damages, losses, liabilities, actions, or causes of action arising out of or related to my participation, except to the extent caused by gross negligence or willful misconduct where such release is prohibited by law.

8. Medical Treatment

If emergency medical treatment becomes necessary, I authorize BlueRock personnel to seek emergency medical assistance on my behalf.

I understand that I am solely responsible for any resulting medical expenses.

9. Personal Property

BlueRock Farm Market is not responsible for lost, stolen, or damaged personal property brought onto the premises.

10. Photography and Video

During your visit, photographs and video may be taken for promotional and marketing purposes.

By entering the property, you grant BlueRock Farm Market permission to use photographs or video in which you may appear without compensation, unless prohibited by law. If you prefer not to appear in promotional materials, please notify a staff member upon arrival, and we will make reasonable efforts to accommodate your request.

11. Ticket Policy

Tickets are non-refundable except as required by law or as otherwise stated in BlueRock's published ticket policies.

BlueRock reserves the right to close attractions, modify activities, limit capacity, or cancel events due to weather, mechanical issues, safety concerns, or circumstances beyond its control.

12. Compliance with Idaho Agritourism Law

Participants acknowledge that they are visiting a working farm and that certain risks are inherent in agritourism activities.

BlueRock Farm Market intends to operate in compliance with all applicable Idaho agritourism statutes and other applicable laws governing recreational agricultural activities.

13. Severability

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Idaho.

15. Electronic Acceptance

By checking the "I Agree" box during online checkout and completing my purchase, I acknowledge that:

I have carefully read this entire Agreement.
I understand and voluntarily accept the risks described above.
I understand I am giving up certain legal rights.
I agree to these terms for myself and any minor children or other participants included in my purchase.
I have the legal authority to accept this Agreement on behalf of all members of my party.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE BOUND BY IT BEFORE PURCHASING TICKETS.
